Selling a car privately in the United States involves more paperwork than most people expect — and the exact requirements vary by state. Getting this right protects you from future liability, makes the transaction smooth for the buyer, and helps you command a better price. Here's what you need, wherever you are.

The Most Important Document: The Vehicle Title

The vehicle title (sometimes called the 'pink slip') is the primary proof of ownership in the US. Without a clean title in your name, you cannot legally sell the vehicle. This is the single most important document in any private car sale.

  • Sign the title over to the buyer: Most state titles have a section on the back for the seller's signature, the buyer's name and address, and the sale price. Complete this at the point of sale.
  • Odometer reading: Federal law (and most states) requires you to record the actual mileage at the time of sale on the title itself. This is the odometer disclosure — falsifying it is a federal offence.
  • Lien release: If you have a loan on the vehicle, the lender holds the title. You must pay off the loan and obtain a lien release before you can transfer a clean title to the buyer. Never sell a car without first confirming the loan is cleared.

Bill of Sale

  • California: Seller must provide a valid smog certificate (within 90 days) for most vehicles. Exempt vehicles include diesel, electric, and vehicles under a certain model year.
  • New York, New Jersey, Colorado, Texas, and others: Require passing an emissions inspection as part of registration renewal, which must be current.
  • Check your state DMV website for your specific requirements before listing — failing to provide a required certificate can block the title transfer.

Vehicle History Report

Running a Carfax or AutoCheck report and providing it to serious buyers is one of the most effective trust-building moves you can make. These reports show accidents, title issues, odometer discrepancies, and service history.

  • A clean Carfax report removes a major buyer objection before they even ask.
  • If the report shows prior accidents, be upfront — buyers will find out anyway and honesty builds trust.
  • Single Carfax reports cost around $40. AutoCheck reports are typically cheaper and provide similar information.

Value-Adding Documents

  • Maintenance records: Oil change receipts, tire replacements, brake work, timing belt — organised in date order. Buyers value documented care.
  • Owner's manual and spare keys: Missing either suggests the car has had a complicated history. Having both is a genuine selling point.
  • Warranty documentation: If a transferable factory or extended warranty remains, provide the paperwork and contact the provider to initiate the transfer.
