Selling a Car Without a Mulkiya in the UAE: Is It Legal? What Are Your Options?

You've found a buyer for your car, agreed on the price, and you're ready to hand over the keys — then you realise the Mulkiya (Vehicle Registration Card) is nowhere to be found. Can you still complete the sale? The short answer is no. UAE federal traffic law is clear: the legal transfer of vehicle ownership cannot be processed at any Roads and Transport Authority (RTA) or equivalent traffic department without the original Mulkiya. But losing it is not the end of the world — a replacement can usually be issued the same day.

What Does the Law Say?

Federal Traffic Law No. 21 of 1995 and its amendments govern vehicle registration and transfer across all UAE emirates. The core rule is straightforward:

  • The Mulkiya is mandatory for any ownership transfer: The RTA (Dubai), Department of Municipalities and Transport (Abu Dhabi), or the relevant authority in other emirates cannot process a transfer of registration without the original Mulkiya.
  • The seller remains the registered owner: Until the transfer is completed at the traffic department, you are still the legal registered owner — meaning you carry liability for any fines or incidents that occur after the car changes hands informally.
  • The buyer cannot re-register the vehicle: Without a legal transfer, the buyer cannot register the car in their name, cannot arrange proper insurance under a clean registration, and cannot renew the Mulkiya when it expires.

Attempting to sell a car without a Mulkiya in the UAE does not just put the deal at risk — it can leave you legally exposed for penalties and incidents that have nothing to do with you.

The Exception: Scrap or Export

If the car is being sold for scrap or final export out of the UAE, the process may differ slightly. However, reputable scrap dealers and export importers will still typically require a loss report or sufficient documentation. A buyer who is willing to take possession with absolutely no paperwork is a serious warning sign.

Step One: File a Loss Report

  • Visit your nearest police station in your emirate — or use the Dubai Police app, Abu Dhabi's Absher app, or the equivalent channel in your emirate — and report the Mulkiya as lost.
  • You will receive an official loss report (بلاغ فقدان). Keep a copy — it is the essential document for the next step.

Step Two: Apply for a Replacement at the Traffic Department

  • Attend an RTA service centre (Dubai), a Tasjeel or Wasel registration centre (Abu Dhabi), or the relevant authority in your emirate, with your loss report and Emirates ID.
  • In most cases a replacement Mulkiya is issued on the same day for a fee of approximately AED 100–200.
  • Some emirates allow you to request a replacement Mulkiya online or through the official app — check what service channel is available in your emirate.

What Can You Do While Waiting for the Replacement?

  • You can agree a sale but not complete it: Nothing stops you from agreeing on a price and taking a deposit. Be transparent — tell the buyer you have filed a loss report and are awaiting the replacement, and set a realistic date for completing the transfer.
  • You cannot legally transfer ownership: Without the original or replacement Mulkiya, you cannot complete the registration transfer at the traffic department. The buyer cannot legally drive the car as the new owner until this is done.
  • You can provide supporting documents: Show the buyer your service history, original purchase invoice, and loss report. These demonstrate you're a genuine seller and build confidence while the replacement is being processed.

The Dangers of Selling Without a Mulkiya

  • You remain legally responsible: Until the traffic department processes the transfer, you are the registered owner. Traffic fines, Salik (toll) charges, and any incidents involving the vehicle can come back to you.
  • The buyer cannot re-register the car: Without a legal transfer, the buyer cannot register the vehicle in their name, cannot properly insure it, and cannot renew the Mulkiya when it expires.
  • It attracts the wrong type of buyer: Serious buyers insist on full documentation. A buyer willing to purchase without a Mulkiya may have dishonest intentions — and if the car is involved in any wrongdoing, your name is still on the registration.
  • Finance risk: If the car is financed, the bank may still hold the Mulkiya. Even if not, missing documentation raises concerns about unresolved outstanding finance against the vehicle.
