Selling a Car Without Registration Papers in Australia: Is It Legal? What Are Your Options?

  • Some states require a roadworthy or safety certificate (e.g., Victoria requires a Certificate of Roadworthiness for most private sales; Queensland requires a Safety Certificate). These are separate requirements on top of the registration document.
  • Without the registration certificate, the buyer cannot complete the transfer at the transport authority and cannot legally use the vehicle as the new owner.

  • You can agree a sale (but not complete it): Nothing stops you from agreeing a price and accepting a deposit. Be upfront—explain you've applied for a replacement and will complete the paperwork as soon as it arrives.
  • You cannot complete the ownership transfer: The buyer cannot transfer the rego without the certificate. They cannot legally use the car on public roads as the registered owner.
  • You can show other supporting documents: Roadworthy/safety certificate (if already obtained), service history, and PPSR check results all build buyer confidence while the rego papers are on their way.

The Dangers of Selling Without Registration Papers

  • You remain the registered owner: Until the transfer is processed, you are legally responsible for the vehicle. Tolls, fines, and any rego renewal notices come to you—even after the car has changed hands.
  • The buyer can't legally transfer or use the car: Without the certificate, they cannot complete the transfer at the transport authority. In some states, driving an unregistered vehicle after purchase carries substantial fines.
