Selling a Car Without Ownership Documents in Canada: Is It Legal? What Are Your Options?

You've found a buyer for your car, you've agreed on a price, and you're ready to hand over the keys—until you realise the Vehicle Ownership Permit (or provincial registration document) is nowhere to be found. Can you still go through with the sale? The short answer is no: selling a car without the ownership document in Canada means the buyer has no legal way to transfer the vehicle into their name. But losing the document is a solvable problem, and replacements are available from your provincial authority.

What Does the Law Say?

Vehicle ownership in Canada is regulated provincially, so the exact document name and process varies. However, the core requirement is consistent across all provinces:

  • The seller must sign over the ownership document to the buyer at the point of sale. In Ontario, this is the Vehicle Permit (often called "the ownership"); in British Columbia, a Transfer/Tax Form is required alongside the registration; in Quebec, the SAAQ manages ownership records electronically.
  • The buyer must then register the vehicle in their province, presenting the signed document to ServiceOntario, ICBC, SAAQ, or their province's equivalent authority.
  • Without the signed ownership document, the buyer cannot plate or insure the vehicle in their own name—which means they cannot legally drive it.
  • Sellers remain registered owners and liable for any fines, plate renewals, or insurance obligations until the transfer is processed.

If you've misplaced the document, you must apply for a replacement before completing the sale. Proceeding without one puts both you and your buyer in a legally precarious position.

The Exception: Scrap or Parts

Wreckers and scrap dealers have their own deregistration processes and may accept vehicles without full documentation in some provinces. Even so, most legitimate recyclers will ask you to apply for a replacement first or will require a statutory declaration. A private buyer who is willing to proceed without an ownership document is a significant red flag—it suggests either title fraud concerns or the buyer's inability to legally register the vehicle.

Lost Your Document? How to Get a Replacement Fast

Apply Online (The Fastest Method)

  • Ontario (ServiceOntario): You can request a replacement vehicle permit online at ServiceOntario.ca. You will need the plate number and your driver's licence. Cost is approximately $32 CAD. Processing typically takes 5–10 business days by mail, or same-day at a ServiceOntario location.
  • British Columbia (ICBC): Visit an Autoplan broker or ICBC office to request a replacement registration. Cost is approximately $18 CAD. Same-day service is usually available in person.
  • Quebec (SAAQ): Quebec ownership is managed electronically; contact the SAAQ online or visit a service point. Cost approximately $25–$35 CAD. Processing varies.
  • Other provinces: Contact your provincial transport authority (e.g., Alberta Registries, MTO Manitoba, Access Nova Scotia). Costs range from $25–$60 CAD and timelines vary from same-day to a few weeks.

Apply In Person

  • Visiting a ServiceOntario, ICBC broker, or provincial registry in person is almost always the fastest route. Bring photo ID and any supporting ownership proof (bill of sale, insurance records, VIN).
  • Once you've applied, keep the confirmation receipt. Share it with your buyer as reassurance that the replacement is being processed—most genuine buyers will happily wait a few days.

What Can You Do While Waiting for the Replacement?

  • You can agree a sale (but not complete it): There's nothing stopping you from negotiating a price and accepting a deposit. Be transparent about the situation—explain you've applied for a replacement and will sign over the document as soon as it arrives.
  • You cannot legally transfer ownership: Without a signed ownership document, the buyer cannot plate, insure, or register the vehicle in their province. They cannot legally drive it as the new owner.
  • You can share supporting documents: Provide a copy of your current registration, service records, and safety certificates. This builds buyer confidence and demonstrates you're a legitimate seller with nothing to hide.

The Dangers of Selling Without the Ownership Document

  • You remain the registered owner and liable: Until the transfer is processed, you are responsible for plate renewals, parking fines, and any incidents involving the vehicle.
  • The buyer can't plate or insure the car: Without the ownership document, the buyer cannot register the vehicle or obtain insurance in their name. Driving it is illegal.
  • It attracts dishonest buyers: Legitimate buyers always insist on proper documentation. Someone willing to buy without it may be attempting to avoid outstanding liens, hide a vehicle's history, or circumvent provincial transfer taxes.
  • Outstanding lien risk: If the ownership document is missing, there is a higher chance of an undisclosed lien (outstanding car finance). PPSA checks are available but buyers will be nervous without a clean paper trail.
