Selling a Car Without a Geran in Malaysia: Is It Legal? What Are Your Options?

You've found a buyer for your car, agreed on a price, and then you go to gather the paperwork—only to find the Geran (Grant—the vehicle ownership document) is nowhere to be seen. In Malaysia, the Geran is the document issued by JPJ (Jabatan Pengangkutan Jalan—the Road Transport Department) that proves legal ownership of a vehicle. Without it, selling a car without a Geran in Malaysia means the buyer cannot complete the official JPJ transfer and cannot prove they are the legitimate owner. The solution is to apply for a replacement before completing the sale.

What Does the Law Say?

In Malaysia, vehicle ownership transfers are governed by the Road Transport Act 1987 and administered by JPJ. The Geran is the central document in this process:

  • The Geran must be presented at a JPJ office when processing the change of ownership. Without it, the official transfer cannot proceed.
  • The seller must sign over the Geran to the buyer, and both parties must present valid MyKad (or passport for non-citizens) at the JPJ office to complete the transfer.
  • Without a valid Geran transfer, the buyer is not the legal owner in JPJ records—they cannot renew roadtax or insurance in their own name.
  • The seller remains listed as the owner in JPJ's system until the transfer is properly completed—which means all obligations (roadtax renewal, insurance, JPJ queries) remain the seller's responsibility.

If the Geran is lost, you must obtain a replacement from JPJ before completing the sale. There is no legal shortcut.

The Exception: Scrap Dealers

Licensed scrap dealers and auto dismantlers in Malaysia may have specific processes for accepting vehicles and managing deregistration. Even here, most reputable operators will require the Geran or a statutory declaration explaining its loss. A buyer willing to purchase without any documentation is a serious red flag and should prompt caution—undocumented vehicle transactions are associated with fraud in Malaysia.

Apply at Your JPJ Office

  • Visit your nearest JPJ office with your MyKad (IC), vehicle details (registration number, engine and chassis number), and a statutory declaration (SD)—a sworn statement made before a Commissioner for Oaths explaining the circumstances of the loss.
  • You must also make a police report at your local police station regarding the lost Geran. Bring the police report to JPJ as part of your application.
  • JPJ may require the vehicle to be physically inspected to verify the engine and chassis numbers before issuing a replacement Geran.
  • A fee applies—the exact amount varies; check the current JPJ fee schedule before your visit.
  • Processing time is typically 2–4 weeks, though this can vary by office and workload.

Online via MyJPJ

  • JPJ has been expanding its digital services through the MyJPJ app and portal. Check whether your transaction can be initiated online at jpj.gov.my or via the MyJPJ app before visiting in person.
  • Once you've submitted your application, keep your reference number and share it with your buyer. Genuine buyers understand that administrative delays happen and will wait for a properly documented vehicle.

What Can You Do While Waiting for the Replacement Geran?

  • You can agree a sale (but not complete it): Nothing stops you from negotiating a price and accepting a deposit. Be upfront—explain you've applied for a replacement Geran and will complete the JPJ transfer as soon as it arrives.
  • You cannot legally complete the ownership transfer: Without the Geran, the JPJ office cannot process the change of ownership. The buyer cannot renew roadtax or insurance in their name.
  • You can share other supporting documents: Your current roadtax sticker, insurance policy, and vehicle service history all reassure the buyer of the vehicle's legitimate status while the Geran replacement is being processed.

The Dangers of Selling Without a Geran

  • You remain the registered owner in JPJ records: Until the transfer is processed, you are the legal owner. Roadtax renewal demands, insurance obligations, and any summons (fines) associated with the vehicle remain your responsibility.
  • The buyer can't renew roadtax or insurance: Without the Geran, the buyer cannot complete the JPJ transfer. Without that, they cannot renew roadtax or get insurance in their own name—meaning they cannot legally drive the car on public roads.
  • It attracts dishonest buyers: Legitimate buyers in Malaysia always insist on a proper Geran transfer. Someone willing to purchase without it may be attempting to avoid the official ownership trail—potentially due to outstanding loans, summonses, or other undisclosed issues.
  • Loan encumbrance risk: If there is an outstanding car loan (hire purchase), the financier's name will appear on the Geran. This must be cleared before the Geran can be transferred to the buyer. A missing Geran may indicate an attempt to conceal an uncleared loan.
